Four Blooms service agreement

Effective November 2, 2026. This is the exact agreement you sign when you accept a proposal.

We don’t offer text messages yet — right now we only reach customers by email.

Draft — have an attorney review. This agreement is written in plain English so it’s easy to read before you sign, but it hasn’t been reviewed by a lawyer yet.

The service

You’re signing up for quarterly seasonal plantings at your property — spring, summer, fall and winter — plus, if this proposal includes it, installing window boxes, porch planters or drip irrigation. There’s no subscription fee and no contract length. You can opt out at any time, at no charge, and any boxes or planters we’ve already installed stay yours.

Before each seasonal planting we email you a flower menu with a few options to choose from. If you don’t choose by the date in that email, we plant the option we recommend.

How billing works

We bill by the foot. Installing boxes and planters, and each seasonal planting, are priced per linear foot (a pot is billed at an equivalent number of feet, by size). Drip irrigation is priced per foot of drip-irrigated planter, with a per-spigot minimum and a per-foot charge for unusually long supply lines. Each planting visit and each install job has a minimum charge. The proposal you’re signing shows the exact rates, minimums and totals for your property.

Prices can change. The flower menu we email before each seasonal planting shows the price for that planting. If it’s different from your last planting, the email says so plainly, and you can opt out at no charge before the planting if the new price doesn’t work for you. A price never changes for a planting that’s already done or already underway.

Sales tax is added to every charge for the service — installs, boxes and planters, drip irrigation, plantings, holiday décor and repairs — at the Texas rate (8.25% today), and shown on your receipt. The deposit isn’t taxed on its own: it’s credited toward your install, and the install is taxed.

The deposit

Signing this proposal includes a deposit, shown on the proposal, charged to your card today. It’s credited toward your install charge — it isn’t an extra fee.

Your right to cancel

You may cancel this agreement at any time before midnight of the third business day after the day you sign it. The cancellation form that comes with this agreement explains how. Business days are every day except Sundays and federal holidays. You can sign and send us the form, or cancel online with the link we email you. If you cancel in time, we refund everything you’ve paid under this agreement, including the deposit, within 10 business days, and the agreement is void. We don’t build anything, order materials or install until that time has passed.

After that, the deposit is non-refundable. We’ll always tell you plainly which situation applies if you ask to cancel.

Your card on file

By signing, you authorize Four Blooms to keep a card on file and charge it automatically for: the install (minus your deposit credit), each seasonal planting, any drip repair you request, any one-off planting you request, and holiday décor if you add it. You don’t need to approve each charge individually — this is your standing authorization for the recurring and one-time charges described in this agreement, off-session (meaning the charge happens without you being present to enter your card again).

Before each planting or install visit, we place a hold on your card for the amount we expect to charge, including sales tax, a few days ahead of the visit, and capture it once the work is done — never more than the hold amount. If a hold fails, we won’t plant until your card is fixed, and we’ll email you a link to update it.

If a charge fails: we’ll email you a link to update your card. If it’s still not fixed after a second email, we’ll cancel your account. Any balance you already owe stays owed even after your account is cancelled or you opt out — opting out stops future work and charges, it doesn’t erase what’s already due for work we’ve completed.

Add-ons you ask for later (a drip repair, an extra one-off planting, adding holiday décor) are only charged once you’ve confirmed them by email — we won’t add a charge you didn’t ask for.

Boxes and planters are yours

Once we install a window box, porch planter or drip line, it’s yours to keep, whether you stay with us or not. If you leave, we don’t take boxes down or patch mounting holes — taking a box down is a separate, quoted job if you ever want one.

HOA and permits

If your property has an HOA or needs a permit for the work, getting any required approval is your responsibility, not ours. Let us know at the design visit if you’re not sure.

Access, pets and presence

You don’t need to be home for an install or a planting. If you’d rather we only came by when you’re home, tell us and we’ll note it on your account — we’ll ask about your schedule before each visit instead of just showing up. Please let us know about any gate codes, dogs or other access details so our crew isn’t caught off guard.

The plant guarantee

Plants in your drip-irrigated planters are guaranteed for the season. If something in a drip-irrigated planter dies from an ordinary planting problem, email us with your address and a photo and we’ll replace it at no charge. The guarantee doesn’t cover a hard freeze, hail, record heat, pests, or any tampering with the planter. Planters without drip irrigation rely on you to keep them watered, so they aren’t covered by this guarantee.

Weather care

We don’t visit just to protect your plants from weather. Every install comes with a printed Homeowner care guide covering what to do before a hard freeze, hail or a severe storm — disconnecting your timer and draining the line, bringing small pots in, and so on. Following it is your responsibility.

Photos

We may take photos of our work at your property and use them in our marketing — on our website, in ads or on social media. We won’t publish anything that identifies your address without your OK.

Texting

We don’t offer text messages yet. Right now we’ll only reach you by email.

The box warranty

Window boxes we build and install are warrantied for 5 years from the install date, covering the box itself and its mounting. If a box we installed fails from a defect or its mounting comes loose, email us and we’ll repair or replace it at no charge. The warranty doesn’t cover damage from storms, hail, falling limbs or other impacts, changes to the wall or box made by anyone else, or a box that someone else has moved or remounted. Porch planters carry their manufacturer’s warranty, which we’ll pass on to you.

Liability

Four Blooms isn’t liable for damage or loss beyond what’s reasonably within our control while doing this work, and our liability for any claim is limited to the amount you’ve paid us for the property in question in the prior twelve months. Nothing here limits liability the law doesn’t allow us to limit.

Texas law

This agreement is governed by the laws of the State of Texas.

Changes to this agreement

We may update this agreement over time. A change only applies to a proposal you sign after the change takes effect — what you sign today is what governs your service unless you sign a new proposal later.
